CLEAN AIR ACT 1993

CITY OF YORK COUNCIL SMOKE CONTROL ORDER (2026)

The Council of the City of York (“the Council”) in exercise of the powers conferred by section 18 of, and Schedule 1 to, the Clean Air Act 1993 (as amended) hereby makes the following Order:

Citation

1. This Order may be cited as the ‘City of York Council Smoke Control Order (2026)’.

Commencement

2. This Order shall come into operation on 1 November 2026 and shall continue in force until varied or revoked.

Declaration and Application

3. The Council declares the whole of the area within its boundary to be a Smoke Control Area (“the Smoke Control Area”). The extent of the Smoke Control Area is shown in the map annexed at Schedule 1 to this Order.

4. This Order applies to all buildings, fireplaces, fixed boilers or industrial plants within the Smoke Control Area unless otherwise excluded from the operation of Schedule 1A to the Clean Air Act 1993.

5. In the whole of the Smoke Control Area created by this Order (that is, all land within the Council boundary), the operation of Section 19A of the Clean Air Act 1993 (Penalty for emission of smoke in smoke control area in England) shall be applicable to all buildings.

Exemptions

6. There are no buildings, fireplaces, fixed boilers, industrial plants that are exempt from the operation of Schedule 1A to the Clean Air Act 1993 under this Order.  

Revocation

The smoke control orders specified in Schedule 2 to this Order; and any other smoke control orders made pursuant to section 11 of the Clean Air Act 1956 or Part III of the Clean Air Act 1993, on or after 13^th November 1980, by the Council, or the authorities specified in Schedule 3 to this Order, in so far as they have been transferred to the Council and apply to the administrative boundary of the Council, are hereby revoked.
